Traffic accidents in Cyprus are on the rise, and the courts are now taking a tougher attitude with much stricter penalties than previously taken with the primary aim of being to prevent future offenders from committing similar offenses.

However, another big issue that is completely attached to traffic accidents is the issue of compensation which the non-culpable part will be compensated for in any involvement in such a traffic accident.

The purpose of an out-of-court settlement through a Legal Representation is not to make the innocent party rich but to receive the compensation to which he is entitled to, compensation which is deducted from the formulation of the Law through previous cases. From the moment the innocent party is legally represented then the one who communicates with the Insurance Company representing the culprit is the innocent party’s Lawyer. Then, after being provided by his client with all the evidences needed to make his claim and support his positions, the Lawyer proceeds to the negotiating partly based on the data before him. In case the counter – proposal of the Insurance Company is considered disproportionate to the innocent party’ s damages then, and after the innocent party’ s wish, the court procedure will begin, i.e lawsuit against the Insurance Company and the driver of the vehicle involved. A process whose path is clearly long and time consuming as a process in the Courts can take many years, often testing the patience of all parties.

The claim for compensations is divided into two parts in the General Compensations (injuries, suffering, pain, etc.) and in the Special Compensations (vehicle damages, payment of medical expenses and medicines, etc.). Cases vary from time to time and this is where the Lawyer should advise the client on his rights.
